HOW CAN I DEFEND MYSELF FROM A COMPLAINT?

Receiving news of being sued can generate anxiety, but it’s essential to remember that filing a lawsuit does not equate to a conviction: it represents the act by which the injured party expresses the desire to initiate criminal proceedings for a specific act, in cases provided by law. In response to a lawsuit, it is crucial to maintain composure, avoid impulsive actions, and promptly consult a lawyer, who can verify the procedural situation, review the available documents, and identify the most appropriate defense strategy. A criminal defense must be based on a precise understanding of the contested facts and the elements collected in the proceedings. Therefore, it is important to keep every document, message, email, photograph, receipt, or other element that can contribute to the accurate reconstruction of the events, avoiding the deletion or alteration of communications and documents. In cases provided by law, the defense attorney may also carry out investigative activities and seek elements useful for the protection of the client. The notice of conclusion of preliminary investigations provided for by Article 415-bis of the Criminal Procedure Code may play a particularly important role, through which the accused is placed in a position to know the acts carried out during the investigations and to exercise the defensive rights provided by law. Defense, then, does not simply consist of “responding” to the lawsuit but requires careful legal analysis of the allegations, the available evidence, the statements collected, and the documentation present in the proceedings. It is also advisable to avoid confrontations, threats, pressure, or impulsive communications with the person who filed the lawsuit, as further behaviors may carry independent legal significance. Every criminal proceeding has its own characteristics, and there is no universally valid defense strategy for every situation. For this reason, if one becomes aware of a lawsuit or receives a document from the judicial authority, it is advisable to promptly consult a professional, submitting all available documentation. A conscious defense begins with knowledge of the acts, the accurate reconstruction of the facts, and the timely protection of one’s rights.
